Terms of Uses

These terms and conditions explain the nature and scope of the relationship between Allsilks Designers Private Limited (hereinafter referred to as “Company”, as the owner and management of the Online Portal of Indian Silk House Agencies); and the Member of the I.S.H.ASilk Club under the category I.S.H.A. Online.

1. PROGRAMME DESCRIPTION

The I.S.H.A Silk Club is a Reward Programme offered by Indian Silk House Agencies through Allsilks Designers Private Limited (hereinafter referred to as the “Company”), on a consumer making a qualifying spend, for rewarding and fostering consumer loyalty towards Indian Silk House Agencies.

2. DEFINITIONS

2.1“I.S.H.A Silk Club” means the instant customer reward program launched at the Online Store offering benefits to customers by reason of their becoming a Memberof the I.S.H.A Silk Club.

2.2“I.S.H.A Silk Card” shall mean the online version of a Membership Card issued by Company to the Members enrolled under the I.S.H.AOnline cateogry.

2.3“I.S.H.A Silk Club Category” shall mean the category named I.S.H.A Online.

2.4“Member” means a customer of the Online Portal of I.S.H.A enrolled as a member of the I.S.H.A Silk Club under the I.S.H.AOnline category.

2.5“Silk Points” shall mean the reward points accumulated by a Member of the I.S.H.A Silk Club in pursuance of the instant Reward Programme.

2.6 “Online Store” shall mean the E-commerce enabled website of Indian Silk House Agencies available at www.indiansilkhouseagencies.com ( or such other online domain as maybe notified from time to time ).

3. I.S.H.A SILK CARD

3.1 Membership into the I.S.H.A Silk Club is voluntary, open to customers with a valid mailing address above the age of 18 and eligible as per the rules laid down by Company, stated herein or notified from time to time. These rules are subject to change.

3.2 A consumer will be enrolled to the I.S.H.A Silk Club only upon duly filling the Application Form issued by the Online Storeor pursuant to an introductory offer, on a consumer making its first purchase.

3.3 On enrollment, each Member shall be assigned a unique Membership Number that will be communicated via email to the Member.

3.4 The I.S.H.A Silk Card can be used only by the Member in whose name the card is issued and is not transferrable. The I.S.H.A Silk Card shall be sent to the registered email address stated by the Member in his/her application form on the website of the Company. By filing out the membership form or upon being allocated a unique membership number or by referring to the Membership number during any transaction including a redemption / accumulation request, an I.S.H.A Silk Member shall be deemed to have accepted the terms and conditions for the I.S.H.A Silk Club Reward Programme as may have been specified from time to time.

3.5 Members are requested to quote their uniqueI.S.H.AOnline Card Membership number at the time of making any purchase at the Online Store.

3.6 In the event the Silk Points are not credited for any purchases at the Online Store after the date of enrollment, it is mandatory on the Member to communicate the same within 30 days atinfo@indiansilkhouseagencies.com. The Member shall be required to produce the relevant invoice in relation to such purchase and thereafter Silk Points shall be credited to their respective account.

3.7 The I.S.H.A Silk Club Membership is valid for the lifetime of the Member unless terminated in terms hereof or at the sole discretion of the Company.

3.8 The I.S.H.A Silk Card is not a credit card or a debit card or a prepaid card. It is not a payment instrument. The I.S.H.A Silk Card and Silk Points therein are non-transferable.

4. I.S.H.A SILK CLUB CATEGORIES

4.1 The online version of the I.S.H.A Silk Club has only one category: I.S.H.A Online.

4.2 The following are the rewards/benefits that are being offered for the time being under the I.S.H.A Online Category :

- Assured gifts with every purchase of Rs. 1500 and above

- Earn Silk Points – 1 point for every Rs. 100 spent

- 1 Silk Point can be redeemed for Re. 1 with every online purchase

- Birthday and Anniversary Gifts

- Complimentary netting on sarees

5. EARNING SILK POINTS

5.1 A Member can earn points by making purchases at the Online Store. A Member can earn 1 Silk Point for every Rs. 100 spent making a purchase online.

5.2 The earning of Silk Points shall be subject to further conditions as follows :

- Silk Points cannot be clubbed with any other offers and / or schemes

- Silk Points cannot be encashed for any reason whatsoever

- The earning of Silk Points shall be on the billed amount net of discounts and excluding taxes, if any

- Silk Points cannot be earned by utilizing any Gift Cards / Certificates / Vouchers or in any similar manner by whatsoever name called

6. REDEMPTION

6.1 Redemption of Silk Points shall strictly only be allowed upon quoting the unique Membership number by the Member himself/herself. Any third person attempting to redeem any points on behalf of the Member shall be strictly required to furnish an authorization letter from the Member in relation to the same.

6.2 Each Silk Point shall entitle a Member to obtain a cash discount of Re. 1 for every purchase above Rs. 1500. Silk Points can only be redeemed in blocks / multiples of 50 units only. The Member shall present his / her Card, in person, with prior request for redemption at the time of billing.

6.3 Points accumulated on a given day cannot be redeemed on the same day but can only be redeemed on the following day. Silk Points are redeemable only against products available at Online Store by way of getting cash discounts on the purchase of such products.

6.4 Products purchased pursuant to redemption cannot be exchanged / refunded.

6.5 On redemption, the Silk Points would automatically be debited from the Member's account.

6.6 The Company reserves the right to update the points system at any time if it deems any future circumstance warrant such a decision.

6.7 Upon redemption of Silk Points for adjustment against a part of the billed amount, the balance amount billed shall be settled by the Member in cash and/or recognized credit / debit card.

7. GENERAL CONDITIONS

7.1 The digital I.S.H.A Silk Card shall at all times remain the property of Company, which reserves the right at any time in its absolute discretion and after informing such Member regarding withdrawal of the Membership and benefits arising out of the same. The Member must return his/her I.S.H.A Silk Card without delay whenever requested by Company.

7.2 When a Member seeks to use or obtain any of the services, benefits, facilities and arrangements as offered by the I.S.H.A Silk Club, the provisions of such services, benefits, facilities or arrangements will be subject to the respective terms and conditions.

7.3 If the details pertaining to the Membership Card is lost or stolen, the Member shall be obligated to report the same for any possible use, otherwise the Company shall not be liable for any misuse.

7.4 You may cancel your Card at any time and you will be given 28 days to redeem any accumulated points outstanding on your Card.

7.5 The terms and conditions of Membership of I.S.H.A Silk Club may be modified at the sole discretion of Company from time to time and would be intimated to the Members and shall be final and binding on the Members.

7.6 The Company reserves the right to change the rate of awarding points, and the type of qualifying purchases, by giving you reasonable notice on the website.

7.7 Without prejudice to any other rights of Company, the Membership of an I.S.H.A Silk Club Member may be terminated by Company at its sole discretion without assigning any reason whatsoever.

7.8 The Company shall be entitled to use the personal information provided by the Member for marketing the I.S.H.A Silk Club Program without further reference to the Member.

7.9 The Company shall not be liable in the event it fails to fulfill any of its obligations under this agreement due to flood, earthquake, storm, cyclone or any other acts of god of similar nature, war strike, lockout, or governmental or judicial or quasi-judicial policies/intervention/direction/prohibition or change in law or for any other reasons beyond its direct control.

7.10 Loss of details of the Card shall be the sole responsibility of the Member and such loss must be intimated by calling or writing any of the Online Store immediately. Neither the Company nor any related entity shall be responsible for any use of the lost/stolen card of any of its Member.

7.11 The Company reserves the right to decline to register or to withdraw and cancel the Card at any time. Should your Card be withdrawn or cancelled, you will be given 28 days to redeem any accumulated points outstanding on your Card. Failure to do so may result in the points being cancelled.

7.12 The I.S.H.A Silk Club Reward Program is a gratuitous program and being made available by Company without any consideration for the same being provided to a specific person or Member and the purchase of products does not form nor shall be deemed to form any consideration for the availability or continuance of this Programme or any benefits thereunder. As such, Company or its directors, employees, agents, affiliates or contractors shall not be held liable for any direct, indirect, special, consequential, remote or punitive losses, damages, costs and expenses, howsoever suffered or threatening to arise against a Member or prospective Member, with or without any act, breach or omission by Company or its directors, employees, agents, affiliates or contractors.

7.13 All decisions of Company in respect of this Programme or any elements thereof including without limitation in respect of the number of Silk Points credited, exclusion of spends, redemption of points, transfer or conversion of Silk Points, eligibility for / or exclusion from the Memberships, election of I.S.H.A Silk Club Category, termination of Membership at discretion of Company, closure or earlier withdrawal of Programme etc. shall be final and binding on a Member or prospective Member.

7.14 Privacy issues are a high priority for All Silks Designers Private Limited and we follow standard industry practices to maintain your personal information. To ensure that the offers and services are relevant we may solicit information from the Members from time to time. This is solely for the purpose of making the program more and more meaningful. We are committed to protecting the privacy of our Members and their transactions

7.15 All disputes shall be subject to the exclusive jurisdiction of the relevant courts / forum at Kolkata and shall be governed by Indian laws.

7.16 Disputes, if any, shall be referred to an Arbitrator to be solely appointed by Company and the proceedings of such arbitration shall be governed by the provisions of the Arbitration and Conciliation Act, 1996.

7.17 The customer can either opt for Friday free shipping for$ 99 OR avail the 10% discount offer for first purchase.
